Reporting by non-bank consumer credit providers to the Czech National Bank

Pursuant to Act No. 257/2016 Coll. (available in Czech only), the Consumer Credit Act, as amended (the "CCA"), non-bank consumer credit providers (NBCCPs) are required to submit by 31 March of the relevant calendar year a statement of activities comprising a balance sheet, a profit and loss account, the amount of consumer credit provided in the previous calendar year and the volume of receivables more than three months past due arising from consumer credit provided as of the last day of the previous calendar year (the "statement"). NBCCPs also report additional data necessary to check compliance with the duties laid down by the CCA, for example the duty to continuously maintain capital of at least 5% of the amount of outstanding loans reported at the end of the calendar year pursuant to Article 14(2) of the CCA. An NBCCP’s capital may not fall below the minimum level of initial capital.

The rules for the annual statement of activities and its form and manner of submission are stipulated in Article 10 of Decree No. 381/2016 Coll., on applications, notifications and the submitting of statements pursuant to the Consumer Credit Act. Statement POSUFI10 must be submitted in the Czech National Bank’s SDAT (available in Czech only) internet application for information duty collection.
